1. Introduction

Welcome to Madeira Outdoors. These Terms and Conditions govern the use of our website and the services we offer. By using our website and services, you agree to these Terms and Conditions. Our Privacy Policy and Cookie Policy are integral parts of these Terms and Conditions.

2. Scope of the General Terms and Conditions

  1. By using our online booking platform for activities and tours on Madeira Island provided by Madeira Outdoors (hereinafter, the “Platform“), you are entering into an agreement with us according to the terms and conditions described in this document (the “Terms of Use“).
  2. For the purposes of these Terms of Use and other policies, any reference to “us”, “we”, “our” refers to Madeira Outdoors.
  3. Through the Platform, Madeira Outdoors acts as:
    • an intermediary offering activities and tours (hereinafter, the “Services“); and,
    • a direct provider of certain activities and tours.
  4. The term “End User” refers to the person who purchases the Experience through the Platform and any other participant joining them. The “Experience” refers to activities and tours related to adventure, hiking, cultural experiences, wellness, accommodation, gastronomy, and more.
  5. The services offered on this Platform are available only to those who can enter into legally binding contracts under applicable law. By accessing the Platform, you declare that you are over 16 years of age and authorized to assume binding obligations regarding any liabilities arising from your use of this Platform.

3. About the Content and Scope of Services

  1. The content of this Platform is prepared to provide information about the Experiences and facilitate payment and booking. You may use the information contained on this Platform only for purposes related to the Services. The information is provided by Madeira Outdoors and third-party providers of the Experiences. In case of errors or discrepancies in the provided information, such as availability for reservations, please contact us.
  2. You may issue opinions, comments, evaluations, emails, suggestions, questions, as long as the content is not illegal, threatening, obscene, racist, defamatory, libellous, pornographic, and does not infringe the provisions of these Terms of Use and other policies. The use of this Platform for commercial purposes is expressly prohibited without prior written authorization.
  3. Madeira Outdoors acts as both a tour operator and an intermediary between the End User and approved suppliers (the “Suppliers“) listed on the Platform.
  4. The services and Experiences of said Suppliers are detailed on this Platform, including videos, photos, descriptions, terms of reservation cancellation, itineraries, and additional information.
  5. Madeira Outdoors offers the Suppliers’ Experiences as a mediator to promote them through its web Platform and is not responsible for the level of service or any damage that occurs during the Experience or for the information that the Suppliers publish on the Platform. If you notice any errors or false information, please contact Madeira Outdoors for correction or removal.

4. Discounts, Discount Campaigns, and Promotion Coupons

  1. Discount promotions allow the acquisition of selected Experiences at reduced prices.
  2. To use these discounts, the End User must enter the code during the purchase or booking process in the corresponding form.
  3. Discount codes are valid for specific groups of Experiences, people, or categories for a specific period. The terms are mentioned in the Reservation Terms on the Experience page.
  4. Discount codes from different campaigns cannot be combined or accumulated. Each code can only be used once and for one campaign. Madeira Outdoors reserves the right to reject requests that do not adhere to these terms.
  5. Discount codes cannot be exchanged for cash or converted into the purchase of another activity.

5. Reservation, Changes, Cancellation, and Experience Refund Policies

  1. Experiences listed on the Platform must be booked with a minimum advance notice specified on the Experience page under “Terms of Reservation”. This notice period varies per Experience.
  2. Once an Experience is reserved, the End User receives a pre-confirmation email containing a code. This code allows participation in the Experience upon final confirmation from Madeira Outdoors.
  3. Each confirmation code is unique and issued for specific dates chosen on the website.
  4. The Experience page will indicate any requirements for participation. If the End User does not meet these requirements, participation can be denied without a refund.
  5. Availability shown on the Platform’s calendar is referential and may be outdated. The reservation is confirmed only after availability is verified and confirmed by Madeira Outdoors via email.
  6. Transportation, accommodation, and meals are not included unless specified and must be arranged by the End User. No compensation or reimbursement will be provided for these additional expenses.
  7. If the End User fails to appear on the reserved date and time without prior cancellation, the right to participate expires without any refund or compensation.
  8. Cancellation policies vary per Experience and are detailed on the respective Experience page. Cancellations must be requested via email.
  9. Refunds, if applicable, will be processed within 7 business days. The End User assumes any costs related to banking fees during the refund process.
  10. Some Experiences require a minimum number of participants. If this minimum is not met, Madeira Outdoors reserves the right to cancel and provide a full refund.
  11. If an Experience is purchased with a discount code and later canceled, only the amount paid will be refunded, not the original price.
  12. In emergencies during an Experience, no refund or compensation will be provided if the guide must apply an internal emergency protocol.
  13. For specific high-demand Experiences like Machu Picchu tours, availability is variable, and the final itinerary may change based on ticket availability. No refunds will be provided for changes in schedule.
  14. Any changes to reservations requested by the End User may incur additional administrative fees and depend on availability.
  15. If the End User makes personal changes to the itinerary, they must cover any additional costs and cannot claim a refund.
  16. For certain treks, participants must sign a sworn declaration before participating. If not completed, participation may be canceled, and a refund provided minus any related fees.
  17. For customized tours, specific cancellation and postponement terms apply.
  18. Representatives of Madeira Outdoors may reject participation if safety or health is at risk without any right to claim a refund.
  19. For every Experience, a WhatsApp group may be created to confirm participation. Lack of confirmation may result in loss of participation without a refund.
  20. Madeira Outdoors reserves the right to cancel tours at any time, offering a full refund.
  21. Last-minute cancellations due to unforeseen circumstances do not entitle the End User to any compensation other than a refund of the payment made.

6. Contracting of the Experiences

  1. Madeira Outdoors communicates that it is not liable for Experiences operated by a Supplier once a confirmation code is issued and confirmed. The Supplier is solely responsible for the quality and any damages resulting from the Experience.
  2. Certain Experiences may not be suitable for everyone due to physical or other conditions. It is the End User’s responsibility to assess suitability and risks.
  3. Adding an Experience to the cart and completing the reservation implies acceptance of all related terms and responsibilities.
  4. Upon booking, the End User must provide complete and accurate personal information. Failure to provide necessary information in time may result in cancellation without refund.
  5. Information about the Experience, including requirements and terms, is provided on the Platform. The End User must comply with all requirements.
  6. Damaged equipment during an Experience must be compensated by the End User.
  7. Punctuality is required for tour pickups. Delays beyond 5 minutes may result in loss of the tour without refund.
  8. Participation in Experiences is voluntary and at the End User’s risk.
  9. The End User must follow all guide instructions. Non-compliance may result in exclusion without refund.
  10. The End User acknowledges the risks involved and releases Madeira Outdoors from liability for injuries or damages.
  11. Travel insurance covering specific risks is mandatory. Madeira Outdoors is not liable for any costs related to medical assistance.
  12. Madeira Outdoors may provide emergency medical treatment if necessary, but costs are the End User’s responsibility.
  13. Madeira Outdoors is not responsible for damages, losses, or claims attributable to the End User or third parties.
  14. Any claims for damages are limited to the price paid for the Experience, excluding insurance premiums and administrative charges.
  15. The End User agrees to indemnify Madeira Outdoors against claims arising from their actions.
  16. Madeira Outdoors may use photos and recordings for promotional purposes.

7. Travel Documents

  1. The End User is responsible for having valid travel documents, including passports and visas. Madeira Outdoors is not liable for consequences of missing or defective documentation.

8. Prices

  1. The price of Experiences includes all services mentioned on the Experience page.
  2. Prices do not include taxes. Foreigners traveling for less than 60 days in Portugal may be exempt from taxes, subject to providing required information.
  3. Payments must be made in the exact amount and condition specified. In case of discrepancies, the reservation may be canceled.

9. Legal Consequences in Case of Loss of Experience

  1. In case of loss or theft of the confirmation code, no refunds or re-issuance will be made. The End User can request a new code by providing personal data and purchase details.
  2. The End User assumes full responsibility for the confirmation code once received.

10. Descriptions of Experiences

  1. Information on Experiences is regularly updated. However, accuracy and availability may vary. Suppliers are responsible for informing Madeira Outdoors of any changes.
  2. Photographs and illustrations on the Platform are referential and provided by Suppliers. Madeira Outdoors is not liable for property rights of Supplier-provided images.
  3. Experience descriptions include detailed information, recommendations, and terms. The End User must comply with all requirements and conditions stated.
